Removal Orders

Canadian immigration authorities have the right to expel any person who is the subject of a removal order. There are three types of removal orders:

  1. Departure Order – persons with a departure order must leave Canada within 30 days, failure to depart will result in a deportation order.
  2. Exclusion Order – persons with an exclusion order cannot return to Canada for a period of 1-2 years. Depending on the reasons for the order, the foreign national may be barred from making an application to return to Canada for 1-5 years. These orders can be issued for violating immigration law, such as; arriving to Canada without a proper visa; overstaying after the visa expires, and; working/studying without proper authorization or a work/study permit. In order to return to Canada less than 12 months after the order was issued, an application for an ARC (Authorization to Return to Canada) is required.
  3. Deportation Order – persons with a deportation order may not return to Canada without written permission from Canadian immigration authorities as it carries lasting consequences – barred permanently from Canada. Usually issued for criminal allegations, security issues, human rights violations, and organized crime.

Detention Revisions

Under the Canadian Immigration and Refugee Protection Act, any person who is not a Canadian citizen can be detained while the Canada Border Services Agency Officers decide if they can enter Canada. Below are a few reasons for detention

  • Criminal convictions – sexual offences, violence convictions, weapons and/or drug trafficking
  • Not complying with any requirements under any Canadian act or regulations
  • Not cooperating with the Canadian Government to establish their identity
  • Links to organized crime, human smuggling, or trafficking
  • A possible danger to the public or security of Canada

Pre-Removal Risk Assessment

If you are being removed, or subject to a removal order from Canada, you may be eligible to apply for a pre-removal risk assessment (PRRA). The Canada Border Services Agency officer will tell you if you are eligible to apply. You may NOT apply for a PRRA if you

  • Made a refugee claim that was ineligible because of the Safe Third Country Agreement
  • Were found to be a convention refugee in another country that you can go back to
  • Are a protected person and already have refugee protection in Canada
  • Are subject to extradition
